Refund Policy

1. Introduction
1.1. This Refund Policy applies to all purchases of digital products made through the website amalgamcaptures.com (the “Website”), which is operated by SIA “amalgam audio”, registration No. 40203260044, registered address “Bernsoni”, Bukulti, Garkalnes pagasts, Ropažu novads, LV-1024, Latvia (“Amalgam Audio”, “we”, “us” or “our”).
1.2. We sell digital products only — including amp captures, DI captures, impulse responses (IRs) and related profiles and files (the “Products”) — which are delivered electronically as downloads. No physical goods are shipped.
1.3. This Policy forms part of, and should be read together with, our Terms and Conditions.
2. Digital Content and the Right of Withdrawal
2.1. Under EU consumer law, consumers normally have a 14-day right to withdraw from a distance purchase. However, for digital content that is not supplied on a tangible medium (such as downloadable files), this right does not apply once performance of the contract has begun with the consumer’s prior express consent and acknowledgement that the right of withdrawal is thereby lost. This is provided for in Article 16(m) of Directive 2011/83/EU on consumer rights and the corresponding provisions of Latvian law.
2.2. Accordingly, at checkout you are asked to give your express consent that delivery of the Product begins immediately upon purchase, and to acknowledge that, by starting the download, you lose your right of withdrawal. Delivery is deemed to begin when the download link is made available to you and/or the download starts.
2.3. By completing a purchase and starting the download, you provide this consent and acknowledgement.
3. No Refunds
3.1. Because our Products are digital content delivered immediately, all sales are final. Once delivery has begun in accordance with Section 2, purchases are non-refundable and cannot be cancelled, returned or exchanged.
3.2. This includes, without limitation, situations where: you have changed your mind; you no longer need the Product; you purchased the Product by mistake; you do not have compatible hardware or software; or you did not read the product description or system requirements before purchasing.
3.3. It is your responsibility to review the product description, audio samples, and system requirements, and to ensure compatibility with your equipment and software, before completing a purchase.
4. Your Statutory Rights (Faulty or Non-Conforming Products)
4.1. Nothing in this Policy affects or limits your mandatory statutory rights as a consumer, which cannot be excluded or waived. In particular, you remain entitled to a remedy where a Product is faulty, corrupted, materially not as described, or otherwise does not conform to the contract, in accordance with Directive (EU) 2019/770 on the supply of digital content and digital services and applicable Latvian law.
4.2. If you experience a technical fault or believe a Product does not conform to its description, please contact us at info@amalgamcaptures.com within a reasonable time of discovering the issue, with your order details and a description of the problem.
4.3. Where a Product is confirmed to be faulty or non-conforming, we will first seek to bring the Product into conformity, for example by providing a corrected or re-supplied file or reasonable technical support. If we are unable to do so within a reasonable time, you may be entitled to a price reduction or a refund to the extent required by applicable law.
5. Discretionary Refunds
5.1. Beyond your statutory rights described in Section 4, any refund is at our sole discretion. Where we choose to grant a discretionary refund, this does not create any obligation to grant refunds in other cases and does not affect the terms of this Policy.
5.2. Any refund that is granted will be made using the same payment method used for the original purchase, unless agreed otherwise.
6. Dispute Resolution
6.1. If you are not satisfied with how we have handled a refund request, please contact us first so we can try to resolve the matter.
6.2. Consumers resident in the European Union may also submit disputes to the European Commission’s Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr. This Policy is governed by the laws of the Republic of Latvia and applicable European Union law, without prejudice to the mandatory consumer-protection rules of your country of residence.
